On September 25th, a Fulton County jury returned a unanimous $140,000 plaintiff verdict after our client, MJ, was tripped and fell in downtown Atlanta, Georgia. We congratulate our client, who fought on when the City of Atlanta refused to negotiate. Morris Haynes attorneys Randy Haynes and Luke Trammell brought the case before a jury after no settlement offers were made.
The ordeal began in February 2022, when MJ fell over an abandoned sign base plate that the City had known about for more than 2 years but never repaired. As a result of the trip, she suffered a compound and comminuted broken wrist, torn ligaments. The injury required surgery and months of physical therapy. Evidence at trial showed multiple citizen complaints and internal City documents proving knowledge of the hazard—proof that this accident was entirely preventable.
“Our client sustained permanent injuries as a result of the City’s failure to maintain its sidewalks,” said Morris Haynes partner Randy Haynes. “This verdict sends a clear message: municipalities cannot ignore dangerous conditions and expect pedestrians to pay the price. We’re proud the jury recognized the city’s failure to act despite repeated warnings from citizens.”
Attorney Luke Trammell says this was about accountability, “It was an honor to represent M.J. She was injured through no fault of her own, and justice was a long time coming, thanks to the City’s vehement attempts to distract and skirt responsibility. I am grateful that the Fulton County jury saw through the City’s charade and did the right thing.”
Morris Haynes holds government entities accountable when they know about safety issues but fail to address them. We thank the jury for their verdict and stand with MJ to demand better from the city of Atlanta. If you or a loved one has been injured, contact our attorneys today to learn how we can assist you.
